Terms of Service
Last updated: 16 July 2026
1. Acceptance of these terms
These Terms of Service (“Terms”) govern your use of DiGi Maker's website-building, hosting, and digital-marketing services, operated by [DiGi Maker’s registered legal entity name — to confirm] (“DiGi Maker”, “we”, “us”). By signing up for or using our services, you agree to these Terms.
2. What we provide
- A branded e-commerce website built for your business, deployed on your own subdomain or connected domain.
- Hosting and ongoing maintenance for that website.
- Payment collection (online via our payment gateway partner, and Cash on Delivery) and delivery, via our logistics partners.
- Optional advertising management on Meta (Facebook/Instagram) and Google, when you connect your ad account(s) to us.
3. Eligibility & your account
You must provide accurate business, contact, and (where applicable) GST/PAN information during onboarding, and keep it up to date. You are responsible for activity under your account and for keeping your login credentials confidential.
4. Fees & payment
Our service fee is billed monthly per the plan you sign up for, on a month-to-month basis — there is no long-term lock-in contract, though we recommend at least a 3-month commitment to see full results from ad campaigns. If you enable advertising, ad spend is separate from our fee and is billed directly by Meta/Google to the ad account you connect — our fee covers the strategy, creative, and management of those campaigns, not the media spend itself.
5. Cancellation
You may cancel at any time; cancellation takes effect at the end of the current billing cycle. On cancellation, we'll provide reasonable assistance transferring your website, domain, and data, per section 7 below.
6. Your responsibilities as a seller
- Provide accurate product listings, pricing, and stock information.
- Only sell products you are legally permitted to sell, and comply with applicable consumer-protection, GST, and advertising laws.
- Fulfil orders in good faith and handle customer disputes reasonably.
- Not use the platform for fraudulent transactions or to mislead buyers.
7. Ownership of your website
Once your website is completed, you own your domain and the resulting website code — DiGi Maker does not hold your site or data hostage. If you leave, we'll help you export/transfer what's reasonably transferable (content, product catalog, domain).
8. Third-party platforms
Where you authorize us to connect Meta, Google, our payment gateway, or a logistics partner to your store, you're also agreeing to that platform's own terms of service and policies. We act on your instructions when managing those connected accounts, and you can revoke access at any time from your dashboard.
9. Advertising campaigns
We manage ad campaigns in good faith using industry-standard practices, but we do not guarantee specific results (sales, leads, or return on ad spend) — performance depends on factors outside our control, including platform policy changes, market conditions, and product-market fit. Campaigns are always subject to Meta's and Google's own advertising policies and approval processes.
10. Acceptable use
You may not use DiGi Maker to sell illegal, counterfeit, or prohibited goods, to run misleading or deceptive campaigns, or to attempt to disrupt or reverse-engineer our platform.
11. Confidentiality
Each party will keep the other's non-public business information confidential, and use it only to perform under these Terms.
12. Limitation of liability
To the extent permitted by law, DiGi Maker's liability for any claim arising from these Terms is limited to the fees you paid us in the 3 months preceding the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits.
13. Termination
We may suspend or terminate an account that violates these Terms, engages in fraud, or fails to pay fees due, with reasonable notice where practical.
14. Governing law & disputes
These Terms are governed by the laws of India. Courts in Gujarat, India shall have exclusive jurisdiction over any dispute arising from these Terms.
15. Changes to these terms
We may update these Terms from time to time; continued use of our services after an update means you accept the revised Terms. Material changes will be communicated to active sellers directly.
